It turns out the statute of limitations runs out 3 years after the LATEST infringement, so the suit could still be in play. In this case a trust of the band member is suing. The trust might claim it wasn't formed until the last three years, so the harm it has suffered is new.

Bloomberg reports that the song had earned $562 MILLION dollars as of 6 years ago!

The 9th circuit court of appeals still threw out a case involving the movie Raging Bull on some other grounds, namely laches - whatever the hell that is. The article says the 9th Circuit is the most hostile court to copyright owners which is damn convenient since its jurisdiction includes Hollywood.

I was pretty sure every member of " Spirit " was deceased ,
with the exception of Jay Ferguson ,,,

but ,,,
this is a trust that is suing , so i was wrong .


Spirit did indeed have many hits .

you just do not hear their music on any so called classic rock radio stations .

any station that plays Tom " Too " Petty , and " Journey " back to back ,
and then plays " Free Bird " by Lynyrd Skynyrd
right after Guns and Roses ,,,

you can bet it's Clear Channel and Murdoch behind such a heinous insult
to the Ears .

yup.gif Radio variety is nearly non existent. Regardless of where you go in the states, they are playing the same format and songs.
It used to be an artist could get airplay without being signed to sony and have millions of dollars backing them, but not anymore.
Even the music has to fit agenda.
