If on private property, and nobody complained, then the Officer has no right to step on your property or to charge you with anything. Even if he witnessed it, unless it's a felony and as long as you aren't exposing yourself to others while doing it it's only a misdemeanor. And as long as the owner of the property is ok with it, then you should be golden.
I would just send the court an affidavit of truth and tell him you do not consent and you waive the benefits. Show up for court (Because if you don't, you go to jail, there for you are complying UNDER DURESS). Tell the judge the exact same thing you wrote in your letter.
